The General Terms and Conditions (GTC) apply to all services and products of
Bergbahnen Brigels AG

  1. General Terms and Conditions

These General Terms and Conditions (GTC) apply to all services and products of Bergbahnen Brigels AG (BB AG). In addition to the General Terms and Conditions, the FIS rules of the International Ski Federation and the SKUS guidelines of the Swiss Commission for Accident Prevention on Snow Sports Slopes also apply as integral parts of the contract.

1.1 Conclusion of contract

The contract between the company and the customer shall come into effect with the order, purchase or use of one or more services. Online orders are concluded with the written confirmation. The service/product descriptions, prices and conditions valid at the time of conclusion of the contract and the GTC valid at that time, which form an integral part of the contract, are thereby also accepted. These services may differ from the printed products and online publications. The GTC valid at the time of conclusion of the contract shall be deemed to have been accepted without reservation.

1.2 Compulsory identification

The personal identity card and all other forms of identification entitling the holder to a discount must be presented at any time when requested by BB AG employees. All tickets are automatically checked at the turnstiles. The lift staff carry out ski pass checks on an ongoing basis.

1.3. data carrier

The KeyCard enables contactless access to all BB AG lifts and cable cars. It can be programmed with new validity dates at any time and can therefore be used for several years. The KeyCard is available at all points of sale for a fee of CHF 5.00 (no deposit, i.e. no refund of the card fee). Visibly defective KeyCards will not be replaced free of charge. KeyTickets are fee-free and contactless disposable cards. They are used for single journeys.

1.4 Data protection

The BB AG privacy policy provides information on what data is collected, how it is used and what rights customers have to their data. This is available at www.brigels-bergbahnen.ch/datenschutz

2.1 Age groups

The BB AG provides for the following age groups: Children up to the age of 5.99 ski for free, but require a ski pass for the turnstiles. Junior tariff applies from 6 years to 16.99 years. Apprentice and student rates apply up to the age of 24.99. The senior rate applies from the age of 64. Adults from the age of 17. The date of issue of the ski pass and the date of birth are decisive for allocation to the categories.

2.2 Families

A family is defined as up to two parents plus any number of children/young people living in the same household.

2.3 Groups

Groups are defined as closed groups such as associations, clubs, organizations and companies of 10 or more people staying in the same accommodation. For groups of less than 20 people, an identical arrival and departure date is also required for all members. The group leader must order, obtain and pay for the tickets for all group members.

2.4. Schools

The school rate applies exclusively to officially recognized schools with 10 or more participants.

3.1 Prices

The prices are published in the printed products and online publications of BB AG and are inclusive of statutory VAT. In the event of different price details in the individual brochures and on electronic media, the provisions according to the current publication on the website www.brigels-berbahnen.ch apply. The online ticket prices are partially discounted. They may vary and are not fixed. The current booked prices apply. All prices quoted are in Swiss francs.

3.2 Payment

Payment shall be made in cash or by cashless means of payment when the contract is concluded and the ticket is issued. The cashless means of payment accepted by BB AG are specified at the points of sale. Ticket purchases against invoice are generally not provided for. The customer undertakes to pay the invoiced amount by the due date. Objections to the invoice must be made in writing and justified within 7 days. If payment remains outstanding after the due date, the company shall be entitled to take legal action and discontinue all services to the customer without further notice. BB AG reserves the right to demand full or partial advance payment for services. Payment transfer fees shall be borne by the customer.

3.3 Payment in the online ticket shop

Payment shall be made exclusively via selected and communicated cashless payment methods. The purchase confirmation will be sent to the e-mail address provided. Online ticket purchases against invoice are not possible. The purchase process is only legally valid once the payment has been debited. If a transaction is canceled or not completed, all tickets shall be invalid.

3.4 Price and service changes

BBB AG reserves the right to change service descriptions and prices on the Internet and in brochures and price lists until the contract is concluded.

4.1 Validity

All tickets are only valid during the published operating hours until the printed end date, are personal and non-transferable. Multi-day tickets are valid on consecutive days until the printed end date. Single-ride tickets are valid for one year from the date of purchase. Multi-ride tickets are valid for two years from the date of purchase. The annual season ticket is valid from June 1 to May 31, regardless of the date of purchase. The annual travelcard can be ordered in advance at reduced rates or with special promotions.

4.2. Loss or theft

Lost, forgotten or stolen day passes, half-day passes and single trips will not be replaced. Annual season tickets and multi-day tickets will only be replaced upon presentation of the blocking and sales receipt and a processing fee of CHF 15.00 including a new keycard. The lost ticket will be blocked. A processing fee of CHF 15.00 will also be charged for incorrectly assigned tickets.

4.3 Misuse

Any misuse of single, day or multi-day tickets and annual season tickets will result in immediate withdrawal without compensation. An administrative fee of CHF 300.00 will be charged. In addition, a valid ticket must be purchased. The right to take civil or criminal action is reserved. The customer is responsible for ensuring that no misuse by third parties is made possible.

5.1 General

The non-use of a travelcard or other ticket that is not due to an accident or illness does not entitle the holder to a refund. All refunds will also be subject to a fee of CHF 15.00. There is no entitlement to a refund or rebooking option for: Single trips, half-day, one-day, two-day, multi-year, optional season tickets and season park tickets as well as in the event of personal impediments, early departure or unfavorable weather and snow conditions. In these cases, no refund or rebooking to another date will be made.

5.2 Disruptions to the provision of services / suspension of operations

5.3. Refund in the event of accident, illness and death

In the event of accident, illness or death of the cardholder and the associated premature termination of the season, the refund claim must be sent by email to verkauf@brigels.ch by the end of the current winter season. Thereafter the claim expires. Annual season tickets or multi-day tickets that can no longer be used will be refunded after submission of a medical certificate and ticket number or order/purchase receipt in accordance with the following provisions of Art. 5.1, 5.3.1 and 5.3.2. Passes/tickets submitted too late and those that were used again after the accident/illness will not be refunded. The certificate must be issued by a practicing doctor. The validity of the travelcard/ticket expires immediately upon receipt of the refund. The refund is made without exception in the form of a voucher from BB AG.

5.3.1. Refund of multi-day tickets

Multi-day tickets are refunded from the three-day ticket. The day following the last day of use is relevant for calculating the refund for multi-day tickets. The validity of the ticket expires immediately upon receipt of the refund.

5.3.2 Refund of the annual travelcard

The percentage for the refund of the annual travelcard is calculated as follows:

80% of the purchase price up to 15.12.

60 % of the purchase price until 31.12.

40 % of the purchase price until 31.01.

20% of the purchase price until 15.02.

From 16.02. no refund

If the annual pass has already been used in summer, the routes already traveled will be deducted from the refund amount in the event of a refund before 15.12.

According to the ordinance, customers can be excluded from passenger transport if, for example: they are drunk or under the influence of narcotics; behave improperly; endanger third parties, disregard the rules of use and conduct or disobey the instructions of staff. In the event of recurrence or in serious cases, the ticket may be withdrawn.

If the weather conditions are unsuitable for the activity, customers may be excluded from transportation.

For unpaid or expired parking fees, Securitas AG will charge a fee of CHF 40. At night there is an absolute parking ban in Zone 1. Vehicles parked incorrectly in Zone 1 will be towed away for a fee. The right to an official report is reserved.

Zone 2 may only be used by Maiensäss owners with a valid special permit. A parking fee of CHF 40.00 will be charged for misuse of the permit.

The ski and toboggan slopes are expertly groomed every day with the utmost care. The marked ski slopes are secured, cleared, monitored and checked by the piste patrollers of Bergbahnen Brigels during the operating hours from 08:30 to 17:00. The marked slopes are closed outside of operating hours so that the slopes can be groomed again. No liability is accepted for personal injury or damage to property caused by disregarding instructions, carelessness, negligence or walking on the lift facilities and slopes during or outside operating hours. Bergbahnen Brigels accepts no responsibility for damage to sports equipment.

It is strictly forbidden to enter or ski in wildlife protection zones. These zones serve to protect wild animals and are signaled or marked accordingly. Violations will be reported to the relevant cantonal authorities. We reserve the right to take further legal action.

If a person has an accident in the area of BB AG and the rescue service has to be called out, the rescue and material costs will be charged. Third-party costs (e.g. Rega, doctor) are to be paid directly by the person concerned. Any claims for reimbursement must be asserted against the relevant insurance company.

Swiss law shall apply exclusively. The exclusive place of jurisdiction for any disputes is the registered office of BB AG.

These General Terms and Conditions are valid with immediate effect and replace all previous ones.
